HERMENÊUTICA E CONSTITUIÇÃO: AS CONSEQÜÊNCIAS DA (INDEVIDA) CISÃO ENTRE EASY CASES E HARD CASES NO DIREITO

RESUMO: O presente artigo aborda a conhecida dicotomia dos easy e hard cases sob a perspectiva da hermenêutica constitucional atual. A partir do diálogo entre tal contraponto e outro, também comum, dos princípios e regras, o texto desmi(s)tifica alguns dogmas da moderna teoria jurídica: Desenvolve a noção de que há uma mera diferenciação entre princípios e regras, e não uma significativa discrepância estrutural, discutindo, assim também, o papel de manutenção da integridade do sistema constitucional que devem exercer os princípios. Da mesma forma, rejeita os aportes tradicionais à problemática dos easy e hard cases , sustentando que a distinção entre estes tampouco é estrutural, encontrado-se, isso sim, na (pré)compreensão do próprio intérprete.

ABSTRACT: The present article deals with the well-known dichotomy of easy and hard cases under the perspective of current constitutional hermeneutic. Starting from the dialogue between such counterpoint and another one, also common, which is that of principles and rules, the text unveils the myth behind some dogmas of modern legal theory: It develops the notion that there is a mere differentiation between principles and rules, and not a significant structural discrepancy, discussing, likewise, the role of constitutional system safekeeping that principles should play. In the same fashion, it rejects the traditional additions to the problem of easy and hard cases, holding that the distinction between these two isn't structural either, but lays, indeed, in the (pre)conception of the interpreter himself.
