ACIDENTE DO TRABALHO E TELETRABALHO: NOVOS DESAFIOS À DIGNIDADE DO TRABALHADOR

RESUMO: O teletrabalho surge e se consolida num cenário de globalização e desenfreado avanço das chamadas TIC´s (T ecnologias de I nformação e C omunicação ). P ressupõe prestador e tomador de serviços separados geograficamente, mas com sua relação laboral mediada por avançada tecnologia. Muito se tem discutido sobre o teletrabalho como alternativa ao desemprego, como inclusora de portadores de necessidades especiais ou, ainda, como nova forma de trabalhar notoriamente em locais onde as questões de trânsito, segurança e meio ambiente estejam próximas ao caos. Entretanto, dúvidas pairam: e a questão infortunística? Quem se ocupa dela? Como tratar juridicamente o acidente do trabalho ou a doença profissional/ocupacional do teletrabalhador? Estará ele ao albergue das mesmas normas protetivas que atendem aos trabalhadores convencionais , prestadores de serviço subordinado no ambiente empresarial? De tudo a certeza de que a dignidade da pessoa humana (tele)trabalhadora está diante de novo desafio, principalmente quando em estado fragilizado, decorrente de abalo à sua higidez física e/ou mental. Será o fim do princípio da proteção?

ABSTRACT: The telecommuting arises and consolidates itself in a setting of globalization and unrestrained advance of the so called TIC´s (Technologies of Information and Communication). It is presumed to employ and produce service separated geographically, but with its laboral relation mediated by advanced technology. It has been greatly discussed about telecommuting as an alternative to unemployment, as including those in need of special assistance or, still, as new forms of work notoriously in localities where the matters of traffic, security, and environment is near chaos. However, doubts still remain: and the question of occupational health and safety? Who is held in charge of that? How can a working accident or occupational illness of the telecommuter be treated juridically? Will he/she have shelter beneath the same protective norms that assist the conventional workers, laborers subordinate to the business environment? Out of everything we need the certainty that the dignity of the human person (telecommuter) worker is faced with a new challenge, mainly when in a vulnerable state caused by the shock to his/her physical and/or mental health. Will it be the end of the principle of protection?
