SÚMULAS, VAGUEZAS E AMBIGÜIDADES: NECESSITAMOS DE UMA “TEORIA GERAL DOS PRECEDENTES”?

RESUMO: As súmulas vinculantes institucionalizadas pela EC 45/2004 vem gerando perplexidades no meio dos juristas preocupados com a aplicação do direito. As súmulas vinculantes devem ser formuladas em linguagem precisa e clara? É possível uma linguagem sem vaguezas e ambiguidades? Ou essa questão não tem importância no plano da hermenêutica filosófica? Essas questões estão tratadas no presente texto, respondendo algumas teses que pretendem uma espécie de “isomorfia” entre linguagem e realidade.

ABSTRACT: The binding precedents institutionalized by the 45th constitutional amendment, of 2004, have been creating some perplexity among legal professionals that are concerned with legal application. Must binding precedents be created in clear and precise language? Or this matter is not that relevant to the phylosophical hermeneutics field? This are the issues faced in this article, which seeks to respond to some of the thesis that intend to create a kind of isomorphism between language and reality.
