RESUMO: Nas páginas seguintes analisaremos direitos individuais ligados à família. Trataremos desses direitos em dois diferentes níveis ou contextos: 1. O “Direito Europeu em um sentido amplo” que identificaremos com o direito gerado pelo Conselho Europeu e com as decisões da Corte Européia de Direitos Humanos (Corte de E strasburgo ). 2. O “D ireito Europeu em sentido estrito” que estará conectado com o direito da União Européia e as decisões da Corte de Justiça das Comunidades Européias (Corte de Luxemburgo). O tipo de casos julgados por essas cortes européias, especialmente a de Estrasburgo, é tão variado e amplo que temos na verdade um catálogo abrangente de decisões que estabelecem diferentes critérios e standards em diversos campos como: o conceito de família, o interesse dos E stados -membros da UE, o direito à casar-se, igualdade entre todos os membros de uma família, aborto e o direito a ter descendentes, adoção, testes de paternidade, educação das crianças... Os princípios e regras que todas essas decisões afirmam são o tópico desse artigo.

ABSTRACT: In the following pages we will analyze individual rights that are linked with the Family. We will deal with these rights in two different levels or contexts: 1). The “European Law in a broad sense” that we will identify with the Law generated by the Council of Europe and with the Decisions of the European Court of Human Rights (Court of Strasbourg) 2). The “European Law in a strict sense” that will be connected with the European Union Law and the Decisions of the Court of Justice of the European Communities (Court of Luxembourg). The kind of cases judged by these European Courts, specially by the Strasbourg one, is so varied and wide that we really have a comprehensive catalog of Decisions that establish different criteria and standards about several fields like: the concept of family, the interest of the U-18, the right to get married, equality between all the members of a family, abortion and the right to have descendants, adoption, inquiries about paternities, education of the children... The principles and rules , that all these D ecisions state, are the topic of this paper .
