EL CONTROL DE CONSTITUCIONALIDAD DE LAS OMISIONES LEGISLATIVAS – ALGUNAS CUESTIONES DOGMÁTICAS

RESUMO: O artigo aborda a caracterização dogmática do instituto da inconstitucionalidade por omissão, os aspectos específicos do controle concreto e abstrato dessa modalidade de inconstitucionalidade e os efeitos da declaração. Baseando-se largamente na doutrina constitucional alemã, o texto trata do tema no âmbito especialmente da ordem jurídica brasileira e portuguesa. São negadas assertivas tradicionais de que o Judiciário passa, através desse controle, a legislar, bem como de que não resulta qualquer efeito prático a decisão que declara a inconstitucionalidade por omissão.

ABSTRACT: The article approaches the dogmatic characterization of the unconstitutionality per omission, the specific aspects of the concrete and abstract review of this type of unconstitutionality and the effects of the declaration. Based largely on the German constitutional doctrine, the text deals with the subject in the framework especially of the Brazilian and Portuguese legal orders. Traditional views are denied, such as that that the Judiciary starts, with such review, to legislate and that no practical effect results from the decision which declares the unconstitutionality per omission.
