JUSTIÇA CONSTITUCIONAL: SUPERANDO AS TESES DO “LEGISLADOR NEGATIVO” E DO ATIVISMO DE CARÁTER JURISDICIONAL

RESUMO: O presente estudo discute a função estruturante, que é a mais difundida entre as funções da justiça constitucional. Tem como enfoque o significado e a relevância da proteção à estrutura normativa, verificando-se em que medida uma atividade desse calibre interfere no e/ou equipara-se ao papel exercido pelo legislador. A tese apresentada é então contraposta à conhecida ideia cristalizada por Kelsen na expressão “legislador negativo”.

ABSTRACT: The present study discusses the structuring function, which is the most spread out among constitutional justice’s functions. It focuses on the meaning and relevance of the normative structure protection, verifying to what extent an activity of this caliber interferes with and/or equates to the legislator’s role. The thesis presented is then set against the well-known idea crystallized by Kelsen in the “negative legislator” expression.
