RESUMO: Com a presente reflexão busca-se arquitetar outra forma de interpretação constitucional capaz de dar novo entendimento à sólida jurisprudência consolidada pelo Tribunal Superior Eleitoral, a qual permite que candidatos sabidamente ímprobos tenham acesso a disputa eleitoral e ao direito de exercerem o poder de representação política.

ABSTRACT: This reflection is intended to propose another form of constitutional interpretation, leading to a new understanding of the solid jurisprudence consolidated by the Superior Electoral Court, which allows acknowledged improbus candidates to access the electoral race and to win the right to take office, exercising the political representation power.
